1. Why should you call us?

2. What you should know about a release from jail:

On average, it takes 4 – 6 hours for the Sheriff to release somebody from custody once the judge signs the bond and the lawyer turns the bond into Central Booking. This does not count the time for the client to be booked into jail by the police. This also does not count the time that it takes for the lawyer to interview the client, gather the background checks, fill out the bond paperwork, and meet with the judge. Please be aware that the person will likely be in custody for a minimum of 6 hours before he or she can be released.

3. When you call us:

Notify us immediately that you need to get someone out of jail. This helps our office prioritize your call as an emergency and handle the case as quickly as possible. If you are calling after business hours, we will know you need to get someone out of jail.

Please have as much as the following information available as possible so we can be of better help to you during our telephone conversation:
1) Name and date of birth of the person arrested
2) When the person was arrested
3) Their employment or education history
4) Your relationship to the person in jail
5) Which jail they called you from
6) What they were arrested for [if you don’t have it, we can look it up]
7) Bond amount [if you don’t have it, we can look it up]
After getting this information, we may need to make some follow-up phone calls to ascertain the bond amount and calculate the cost of doing the jail release. Once we can quote the fee for the release, we will either take payment by credit card over the phone, or make other payment arrangements with you.
We can be reached 24 hours a day at 512-457-5200 to handle a jail release. If the answering service answers, just let them know it is a jail release and they will make sure an attorney is contacted immediately.
A portion of the amount paid toward a jail release will be credited toward legal fees if we are later hired to handle the criminal case.

4. Why hire a lawyer over a bail bondsman?

Nobody plans to be arrested. Most of our clients have never had to make arrangements to get somebody out of jail, and we acknowledge that it can be a sensitive and, at times, embarrassing situation. It is equally awkward for the person in jail. Given everything that has just happened, people that have just been arrested have a number of legal questions that a bail bondsman can’t answer. We feel that meeting with a client in their greatest moment of crisis is of tremendous importance—even at 4:00 in the morning.

First, you will pay less.

When you hire a bail bondsman, you will pay 10%- 20% of the bond amount plus guaranteed security and collateral in the amount of double the bond.

Second, it's a better investment.

A bail bondsman makes 99% of their money from the first couple of hours of getting you out of jail. They're taking a financial risk based on whether or not their client will show up to court in the future. For example, if you spend $4,000 on a bail bondsman to get you out of jail, you are paying them $1,000- $2,000 an hour. The bondsman will hold the bond until the end of your case, but you will never get that money back, nor can it be applied to attorney's fees. This money can be better invested in hiring a good defense lawyer than in making a quick decision to use a bail bondsman to get someone out of jail.

Third, a lawyer can start on your case at this very important time.

Investigation begins the moment you've been arrested. Once someone is arrested and in jail, the clock starts ticking in terms of finding witnesses, getting witness statements, collecting evidence, and mounting an effective defense to possibly keep a case from being filed or even indicted. Once somebody is out of jail, normally they tend to rest on their heels and wait as their court date draws near. This is a bad idea! If you are serious about contesting your case and keeping a conviction off of your record, you should have a lawyer on your case from the minute you step foot in jail. That lawyer will be able to take a very detailed statement from you, as we expend a lot of time with interviews and collecting evidence. We can begin working on the case immediately to determine if there is any evidence that may have been lost or destroyed. Furthermore, by having a lawyer involved at the outset, we are sometimes able to get affidavits, non-prosecution, or witness statements that may not be as valuable if they are taken weeks or months after the date of arrest. The police officers likely already have the witness statements from the day of or day before the arrest and it is important, if not imperative, for us to be on an equal playing field with them. The clients that use our services to get them out of jail are often able to mount a very effective defense because we have such an advantage in terms of time.

Fourth, hiring a lawyer to perform your jail release will save you time
and stress.

If you hire a lawyer for a jail release, there will be one less person you will have to tell the traumatic events of your arrest to. By having a lawyer involved at the outset, hiring an attorney will no longer be on your "to-do" list. Aside from the fact that we will credit a portion of the jail release fee towards your defense, we will be in a better position to advise you as to what to do when you are out of jail, especially in cases involving protective orders, pretrial release, personal bonds or different conditions of those bonds. We can advise you where to stay or what to do in order to limit your exposure to the criminal system. Jason Trumpler is a former prosecutor with exceptional trial experience. Mr. Trumpler graduated magna cum laude from Whittier College in 1997, with a Bachelor of Arts degree in Political Science. He obtained his law degree from the University of Texas at Austin School of Law in 1999.

Before opening his own office, Mr. Trumpler was the Supervising Attorney of the Orange County, California Office of The Law Offices of Myles L. Berman, a firm that specializes in drunk driving defense. Prior to working for The Law Offices of Myles L. Berman, Mr. Trumpler spent three years working for the Orange County District Attorney's Office.

During his tenure with the Orange County District Attorney's Office, Mr. Trumpler handled thousands of criminal cases at both the pre-trial and trial stage. In addition, he trained law enforcement officers throughout the county. Mr. Trumpler also previously worked with the Ventura County District Attorney's Office as a Deputy District Attorney. In that capacity he also handled hundreds of cases.

Over his career, Mr. Trumpler has completed close to 100 jury trials. Mr. Trumpler concentrates his practice in defending people accused of crimes throughout Central Texas and Southern California. Mr. Trumpler now resides and maintains the headquarters of The Law Offices of Trumpler & Troberman in Austin, Texas. Mr. Trumpler has been licensed to practice law in the State of Texas (Bar # 24053913) since 2006 and the State of California (Bar # 210564) since 2000. In 2005, Mr. Trumpler was admitted to practice before the United States District Court, Central District of California. In 2011, Mr. Trumpler was admitted to practice before the United States District Court, Eastern District of Texas.

Mr. Trumpler is or has been a member of the Austin Bar Association, Williamson County Bar Association, the National College for DUI Defense, The National Association of Criminal Defense Lawyers, and the Austin Criminal Defense Lawyers' Association.

Additionally, Mr. Trumpler is a proud veteran of the United States Army. He received his honorable discharge in April of 2003. He served his country from 1996 to 1997 as a peace keeper in the former Yugoslavian Republic of Bosnia. In his spare time, he enjoys spending time with his four sons, reading, and traveling.

Meredith Troberman was born in San Antonio, Texas but spent her childhood and early adult years in the Dallas/Ft. Worth area. Ms. Troberman attended the University of Texas at Austin and graduated in 2001. Meredith then pursued her life long dream of becoming a lawyer and attended St. Mary’s School of Law in San Antonio and graduated in 2006. Meredith became licensed to practice in both the State and Federal Court in 2006.

While in law school, Meredith gained invaluable experience beyond the classroom working as an intern in the Bexar County District Attorney’s Office. Before she even graduated, Meredith tried several cases, receiving a firsthand education on the criminal process through the “lens” of a felony prosecutor. Also while in law school, Meredith was a chosen member of the highly competitive St. Mary’s External Advocacy Program where she traveled all over the country and received numerous awards for her outstanding advocacy skills. Meredith was, on several occasions, recognized as one of the best oral advocates in her 2006 graduating class.

After her third year of law school, Meredith was hired as a law clerk for famed San Antonio defense Attorneys Gerry Goldstein and Cynthia Orr; as seen on CNN, ABC, FOX, Court TV, 20/20 and many other news programs. After passing the Texas Bar Exam, Meredith accepted an attorney position with Goldstein, Goldstein and Hilley and worked on a number of State and Federal cases. During this period of time, Meredith learned the defense process from pre-indictment all the way through the appeal from two of the very best criminal defense attorneys in the country, Gerry Goldstein and Cynthia Orr.

After leaving Goldstein, Goldstein and Hilley in January of 2007, Meredith became a prosecutor in Austin, Texas. As a prosecutor, Meredith gained extensive experience in the courtroom trying cases, as well as behind the scenes negotiating cases. She understands cases from both the State and defense perspectives, easily recognizing issues and weaknesses. Meredith is extremely familiar and comfortable in the Travis County Courts and with all the parties associated therein. She uses this knowledge to the advantage of all her clients.

After leaving the Travis County Attorney’s Office, Meredith chose to put her experience to work and open her own criminal defense firm, representing those accused of criminal conduct by the government. Meredith’s law practice is dedicated to defending the rights of the criminally accused against prosecution by the State of Texas and the Federal Government. Unto every case she has been part of, Meredith Troberman brings compassion, experience, and skill defending the criminally accused.

Tarrant County DA Posts DWI Suspects On Website

In late December, the Tarrant County District Attorney's office announced its intention to post the names of people arrested on suspicion of DWI during New Year's Eve weekend. As reported in the Fort Worth Star-Telegram, the DA followed through with this plan in early January, posting the names of over 100 people arrested for suspicion of DWI in Tarrant County.

This move has not been without controversy, and many Tarrant County defense attorneys believe the DA has gone too far. Writing in a Fort Worth Star-Telegram op-ed piece, attorney Richard A. Henderson notes that the Tarrant County Criminal Defense Lawyers Association is considering asking the State Bar of Texas for a formal ethics ruling on the propriety of publicizing the names.

In his article, Henderson notes that the Texas Disciplinary Rules for lawyers already say that a lawyer should not seek publicity to gain an advantage in a legal proceeding. He also notes, importantly, that prosecutors have a special obligation not merely to get convictions but to seek justice.

We have not posted about this issue before, but I must say I agree with Mr. Henderson's column. While the DA's website notes that these are “alleged drunken drivers” and that they are innocent until proven guilty, publicizing the names appears designed to punish people who have been arrested for suspicion of DWI in Tarrant County even before they have been proven guilty. We will be very interested to see what the State Bar says about the subject. We suspect that the Tarrant County DA has not done anything illegal or unethical under the law or the State Bar rules, but just because something is not illegal doesn't make it right. In this country, in this state, people accused of a crime – even those arrested for suspicion of DWI – are innocent until proven guilty. The state has many advantages already, it is difficult to see what this accomplishes other than imposing preemptive punishment and implying guilt.

Over the weekend, the El Paso Police Department arrested nine people for suspicion of DWI. According to news reports, the arrests occurred between 1:15 a.m. and 2:52 a.m. Saturday morning. A news item can be found at the link below.

As we have documented on the blog before, law enforcement agencies in Texas increase their DWI enforcement efforts around the holidays. This article notes that of the nine arrests, three were charged with DWI with a blood aclohol content (BAC) greater than 0.15. This is the new Texas law (Texas Penal Code 49.04(d)) which makes a first DWI offense a Class A misdemeanor where the BAC is measured to be 0.15 or above. Until this law took effect in September 2011, first DWI offenses were Class B misdemeanors.
